I noticed that the contact form is now "opt in" rather than "opt out", which seems to be a change since the documentation I've found here references 'out opt'.

Unless the checkbox is marked, the prospect's information is not saved to the membership management module.

What is the rationale for "opt in" instead of "opt out"?

Can the prospect info be collected regardless of opt in choices and have an indicator on the individual prospect record?

Thanks for any information you can provide - and apologies if I overlooked a forum discussion or document on the topic.

Look for CASL in the forum posts. Also, Brian had requested in the past that I change it to opt-in because of it autopopulating contact information to Membership Management. I had put it off for a long time but finally bit the bullet and changed it.

Because the system is used internationally, we have to be sensitive to some of the "IT politics" related to the system. I am not a big fan of the opt-in either, but there are more reasons for it to be opt-in than not.

Ah, of course. That makes sense. Thanks.

Could it potentially be a contact form setting to select the opt-out vs. opt-in option?

Make the default setting 'opt-in' and include a description next to the settings warns to "check your country's data privacy laws before choosing opt-out".

Perhaps, but I would like to get Brian's thoughts on that first.

I've updated the docs to reflect the change to "opt-in".

Opt-in allows us to fight the black listing of the FTH domains. If a person opted in them we can have the black listing removed.

Added setting for this in the Email and Contact Forms module. However, the default is still opt-in (as it should be), unless you override it with the setting.
