CASL - Canadian Anti Spam Legislation

I am trying to make sure our club conforms to the Canadian Anti-Spam legislation.

Has anyone else here had to deal with these issues?

Would it be possible to add a flag indicating that the user did not want to be sent emails?

The emails are only sent to members, so they are not spam.

As far as guests and former members, there is an opt out link.

"Opt out" measures don't meet the requirements of this new law. Express consent is required:
The manner in which you request express consent cannot presume consent on the part of the end-user. Silence or inaction on the part of the end-user also cannot be construed as providing express consent. For example, a pre-checked box cannot be used, as it assumes consent.

Rather, express consent must be obtained through an opt-in mechanism, as opposed to opt-out. The end-user must take a positive action to indicate their consent. For example, this can be done by providing a blank box which a user can check off to indicate consent.

Would it be possible to have an option for the contact form that allows prospects to opt in instead of opt out?
